1. Scope
These Terms of Service govern the use of Summa, a digital loyalty card platform operated by Ferdinand Salis ("Summa").
By using Summa — as a card user or as a shop — you enter into a legally binding agreement under these Terms.
Summa is a technical platform and does not sell goods, services, or benefits.
2. General
Summa provides a digital system that allows shops to offer loyalty programs and card users to access them via a digital card.
No specific features or continuous availability are guaranteed. Summa may modify, limit, or discontinue the service at any time.
3. Card Users
Access to the digital Summa card is provided via a personal card link, which must be kept confidential.
All benefits (e.g. rewards or discounts) are defined and provided solely by the participating shop. Summa makes no guarantees regarding benefit availability, value, or duration.
Benefits:
- have no cash value
- are not monetary credit
- cannot be exchanged for cash
Using Summa does not create a purchase or service contract with Summa.
4. Shops
Shops must provide accurate and up-to-date information, especially regarding benefits and conditions.
Use of Summa by shops may be subject to recurring fees. Fee details are agreed separately and may be adjusted with reasonable notice.
Shops are solely responsible for:
- benefits offered
- fulfillment of offered benefits
- compliance with applicable laws
Summa is not a party to transactions between shops and card users.
5. Benefits & Disputes
Benefits are voluntary offerings provided by shops and may be changed or discontinued at any time.
Any disputes regarding benefits, goods, or services must be resolved directly between the shop and the card user.
6. Liability
Summa is provided "as is".
To the extent permitted by law, Summa is not liable for:
- indirect or consequential damages
- service outages, data loss, or technical issues
- actions or promises made by shops
Mandatory statutory liability remains unaffected.
7. Termination
Use of Summa may be discontinued at any time. Summa may suspend or discontinue the service or access to it at any time.
8. Governing Law
Austrian law applies. Jurisdiction is Vienna, Austria, unless mandatory consumer protection law provides otherwise.
